Dear Berkeley Unified School District Families,

We want you to know that we are committed to protecting the right of every student to attend public school, regardless of immigration status of the student or of the student’s family members. 

On December 7, 2016, the Berkeley Unified School District Board of Education adopted an official policy <http://www.berkeleyschools.net/2016/12/09/new-board-policy-on-undocumented-students/> that provides protections to immigrant families and affirms the right of undocumented children to a public education. This right has also been upheld by the United States Supreme Court in a case called Plyler v. Doe <https://www.americanimmigrationcouncil.org/research/plyler-v-doe-public-education-immigrant-students>.

On January 25, 2017, the Board will adopt a resolution that reiterates its position that all students have the right to attend our public schools, regardless of the immigration status or religious affiliation of the student or of the student’s family members.

Because it is our duty and responsibility to provide each child in our District with a high quality public education in a safe and nurturing environment, we have given these directions to the staff at our schools:

Our staff will not request information or make a record of information on the immigration status of a student or family member. Furthermore, students and families will not be required to provide a social security number for school forms.

If the Immigration and Customs Enforcement (ICE) agency asks for access to a school or for access to student information, they will be politely denied and referred directly to the Superintendent or Assistant Superintendent for Educational Services who will refer the matter to the District’s legal counsel.

Anyone in our schools seeking answers to questions about immigration will be referred to local non-profit immigration law organizations, such as the East Bay Community Law Center <https://ebclc.org/> and the  East Bay Sanctuary Covenant <https://eastbaysanctuary.org/> or other recommended resources available on the district website <http://www.berkeleyschools.net/resources-for-immigrant-families/>.

Our immigrant families are not the only ones who are concerned about possible changes in federal policies. We want you to know that our district rejects all discrimination based on race, ethnicity, religion, gender, gender identity and expression, immigration status, disability and sexual orientation.

Estimadas Familias en el Berkeley Unified School District,
 
Deseamos que ustedes estén enterados que estamos comprometidos a proteger el derecho de cada estudiante que asiste a la escuela pública, sin tomar en cuenta el estado migratorio del estudiante o de los miembros de su familia.

El 7 de diciembre, 2016, la Mesa Directiva de Educación (Board of Education) de Berkeley Unified School District aprobó una política oficial <http://www.berkeleyschools.net/2016/12/09/new-board-policy-on-undocumented-students/> la cual provee protecciones para las familias inmigrantes y afirma el derecho que tienen los niños indocumentados de a recibir educación pública. Este derecho ha sido también defendido por la Suprema Corte de los Estados Unidos en un caso conocido como Plyler v. Doe <https://www.americanimmigrationcouncil.org/research/plyler-v-doe-public-education-immigrant-students>.

El 25 de enero, 2017, el Board aprobará una resolución que reafirma su posición de que todos los estudiantes tienen el derecho de asistir a las escuelas públicas, sin tomar en cuenta el estado migratorio  o afiliación religiosa del estudiante o de los miembros de su familia.
 
Debido a que es nuestro deber y responsabilidad el ofrecer a cada niño en nuestro Distrito una educación de alta calidad en un medio ambiente seguro y enriquecedor, hemos dado al personal docente de nuestras escuelas estas instrucciones:
 
Nuestro personal docente no solicitará información, o registrará información referente al estado migratorio de un estudiante o de un miembro de su familia. Asimismo, los estudiantes y sus familias no van a requerir presentar un número de seguro social en los formularios escolares.
 
Si la agencia de Servicio de Inmigración y Control de Aduanas (Immigration and Customs Enforcement -ICE-) solicita tener acceso a una escuela o tener acceso a la información de un estudiante, amablemente se le negará el servicio e inmediatamente serán referidos al Superintendente o al Superintendente Adjunto de Servicios Educacionales los cuales referirán el caso al Asesor Legal del Distrito.
 
Cualquier persona en nuestras escuelas que esté buscando respuestas a preguntas relacionadas con inmigración será referida a las organizaciones locales no lucrativas que trabajan con las leyes de inmigración, tales como East Bay Community Law Center <https://ebclc.org/> y East Bay Sanctuary Covenant <https://eastbaysanctuary.org/> o a otros recursos recomendados disponibles en nuestro sitio web <http://www.berkeleyschools.net/resources-for-immigrant-families/>.
 
Nuestras familias inmigrantes no son las únicas que están preocupadas acerca de los posibles cambios en las políticas federales. Deseamos que ustedes estén enterados que nuestro distrito rechaza toda la discriminación que se base en la raza, origen étnico, religión, género, identidad y expresión de género, estado migratorio, discapacidad y orientación sexual.
