2.1-A Resolution 09-37 - Decrease Number of Certificated Employees Due to
Reduction in Particular Services
The Board passed Resolution No. 09-37 to decrease the number of certificated employees for 2009-2010. The District is confronted with budgetary problems that reduce its ability to provide services at the same
level, and in the same manner as provided in previous years. As a
consequence, the Board has the authority to reduce or discontinue
particular kinds of services. "Particular Kinds of Services" are those
services that are scheduled to be eliminated which are currently being
provided by District certificated employees.

The resolution presented approved by the Board is necessary in order to
give the Board flexibility to deal with the budget crisis as it unfolds in
the coming months. The resolution affects 120.37 FTE (Full Time
Equivalency). 

2.2-A Resolution No. 09-38 - Criteria for Determining the Order of
Seniority
The Board approved Resolution 09-38. The resolution establishes the
seniority criteria for employees with the same first day of paid
probationary service. This is a critical part of the necessary reduction
of services. The list of employees affected will come back to the Board
for action on March 11, in order to meet the requirement to notify
certificated employees by March 15th, 2009 that they may not have a job
with the District next school year. Final notification occurs in May.
Notification of classified employees is required 45 days prior to the last
day of work, so any positions affected by the budget cuts will come before
the Board in April.

3.1-I  California Healthy Kids Survey Report
The Board received a report on the California Healthy Kids Survey which is
given to 5th, 7th, 9th and 11th grade students every two years. The report
by the Berkeley Evaluation and Analysis Department provided a detailed
look at specific areas of the survey and will be available on the website
for review: www.berkeley.k12.ca.us
